Limited Product Warranty
Alyeska Dogsled Works, Inc. (Alyeska) warrants that defects in
materials and workmanship present in all products provided by and
through Alyeska at the time of delivery to the original purchaser will
be repaired or, at Alyeska's sole discretion, the product will be
replaced at no charge if repairs cannot be made. Alyeska further warrants
to the original purchaser that it has the right and authority to sell
its products and those products are free and clear from any and all
liens, claims, security interests and encumbrances. Alyeska makes no
warranty with respect to product performance and conditions during use
or non-conformities, damages, injuries or death(s) caused by misuse,
neglect, accident or abuse by anyone.
Limitation of Liability
Alyeska Dogsled Works, Inc. (Alyeska) shall in no event be liable to
the original purchaser, its customers or to any other person or company
using or involved with any Alyeska product(s) and/or parts for loss of
use, loss of profit, inconvenience, property damage caused by Alyeska
products and/or parts, performance of the Alyeska products and/or parts,
personal injury caused by or involving Alyeska products and/or parts
or death(s) caused by or involving Alyeska products and/or parts whether
in an action for or arising out of breach of warranty, breach of contract,
delay, negligence, strict tort liability or otherwise. IN NO EVENT AND
UNDER NO CIRCUMSTANCES SHALL ALYESKA BE LIABLE FOR INDIRECT, SPECIAL,
INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES. Alyeska's entire liability
for any claim of loss, damage or expense from any cause whatsoever shall
in no event exceed, at Alyeska's option, the repair, replacement cost or
purchase price of the Alyeska product and/or part which directly gives
rise to the claim. No action or proceeding against Alyeska may be commenced
more than twelve (12) months after the Alyeska product and/or part is
initially provided to (shipped) to the original purchaser.
These Limited Warranties and Limitation of Liability are governed by and
construed in accordance with the laws of the State of Minnesota, without
regard to or application of conflicts of law rules and principles. If
for any reason a court of competent jurisdiction finds any provision or portion of
the Limited Warranties and/or Limitation of Liability to be unenforceable,
that provision will be enforced to the maximum extent permissible so as
to effect its intent, and the remainder of the Limited Warranties and/or
Limitation of Liability will continue in full force and effect.
THE FOREGOING WARRANTIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
